Terms of Service

1. Use of the App

BPTally is a blood pressure tracking app that helps you log readings and monitor heart health trends. You may use the app for lawful purposes only. You agree not to:

• Use the app for any purpose other than personal blood pressure tracking.
• Attempt to reverse engineer, modify, or interfere with the app's functionality.
• Abuse the service by submitting excessive or automated requests.
• Share your account credentials with others.
• Use the app to collect or store data about other individuals without their consent.

2. Age Requirement

You must be at least 14 years old to use BPTally. By using the app, you represent that you meet this age requirement. If you are under 18, you confirm that you have the consent of a parent or legal guardian.

3. Accounts

After launch you may create an account using email/password, Google, or Apple Sign In. You are responsible for maintaining the security of your account and all activity that occurs under it. You can delete your account at any time through the app's Settings, which will permanently remove all your data.

4. Pre-Launch Waitlist

The pre-launch waitlist exists for a single purpose: to notify you when the iOS and Android apps go live. We will send at most one launch announcement plus a confirmation email. You can request removal at any time by emailing start@djump.io.

5. Free and Premium Plans

BPTally offers a free tier and premium subscriptions:

• Free: Log blood pressure readings with 7-day history, automatic AHA categorization, and weekly averages.
• Premium ($2.99/month or $24.99/year): Unlimited history, trend charts, advanced statistics, BP goal tracking, PDF/CSV export, and doctor-shareable reports.

• Premium subscriptions are billed through Apple App Store or Google Play Store.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription in your device's subscription settings.
• Refunds are handled by Apple or Google according to their respective policies.

6. Health Disclaimer

BPTally is a general wellness tool and does not provide medical advice. Blood pressure categories are based on American Heart Association guidelines and are for informational purposes only. Your actual health needs may vary. Always consult a healthcare professional for medical advice, diagnosis, or treatment. Do not use BPTally as a substitute for professional medical guidance, especially in emergencies or if readings indicate Hypertensive Crisis (above 180/120 mmHg).

7. Intellectual Property

BPTally and its original content, features, and functionality are owned by DJUMP, MB. You may not copy, reproduce, distribute, or create derivative works from any part of the app without our written permission. Your blood pressure data and personal records remain yours.

8. User Representations

By using the app, you represent and warrant that:

• All information you provide is truthful and accurate.
• You have the legal capacity to agree to these Terms.
• You will not use the app for any illegal or unauthorized purpose.

9. Disclaimer of Warranties

The app is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the app will be available at all times, error-free, or that blood pressure categorizations will be completely accurate for your specific health situation. The app is not a medical device and should not be used as a substitute for professional health monitoring equipment.

10. Limitation of Liability

To the maximum extent permitted by law, DJUMP, MB shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app, including but not limited to any health outcomes related to following or not following the app's blood pressure categorizations.

11. Termination

We reserve the right to suspend or terminate your access to the app at any time, without prior notice, for reasons including but not limited to:

• Breach of these Terms
• Engagement in prohibited activities
• Request by you to delete your account
• Legal or regulatory requirements

12. Privacy

Your use of the app is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information and health data.

13. Dispute Resolution

In the event of a dispute, you agree to first attempt to resolve it informally by contacting us at start@djump.io. If the dispute is not resolved within 30 days, it shall be submitted to the exclusive jurisdiction of the courts of the Republic of Lithuania.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the app or by updating the effective date above. Continued use of the app after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Lithuania.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.
